I don't think I have to say this here but.. Vote NO on Genocide Joe! To all those who think voting for Genocide Joe is the lesser of two evils, NO, you are voting for GENOCIDE. Stein or West is a vote to Free Palestine. To all those that do vote for Genocide Joe, may you hear the screams of the Palestinians murdered in this Genocide as your head hits the pillow every night.

The ICJ tried to split the baby. As Chris notes - it doesn't matter.

Force is what stops a bully. Not clever word games, not memes, not moral preening. Europeans went from chest-thumping megalomaniacs, the folks who brought us imperialism and colonialism, to mild-mannered metrosexuals, just as soon as they met The Red Army and they decided that this "the world belongs to the strong" stuff isn't nearly as much fun when you're on the receiving end.

Note that Biden could stop this with a phone call.

So the Court demanded all of the elements of a ceasefire without specifically calling for one by name, and clearly described the ongoing genocide without ruling that it is (that'll take years). Of course Mr. Hedges is right that this won't, by itself, stop the slaughter, but it's a significant step in that direction. Bravo, South Africa! You've come a long way.

Does anyone believe that Israeli - the colonial, settler, Zionist what is mine is mine and what is your is mine too - big tough he-men will do anything but go home tonight and raise a brew and toast their win? And Biden, with a fragile position in the electoral rankings, but a '50's war-hawk America is tough lens to see through, will crusade on with his emptying our bodego of millions and war material with a pink bow for his close Bibi buddy. How is it that he hasn't a clue that some of his undecided are deciding to vote for West and Williamson because of his gigantic favors to Big Oil which ultimately will bury our young under searing climate catastrophes and his ignorant, stupid, and dastardly support of more death to Palestinians. I just read Seth Jackson's article in Jacobin magazine "There was an Iron Wall in Gaza". His descriptions of the Deir Yassin massacre is blood curdling, to say the least. It puts Oct 7 in perspective, having his quotes and story memorized would freak out most people. Like Bibi's dream that Israel might someday get an opportunity to "finish the job of 1948" Nakba. Irgun attacked the peaceful Deir Yassin on April 9 1948 for "the liquidation of all men in the village or any other force that opposes us, whether it be old people, women or children." One example is of a 9 month pregnant woman, shot in the neck and a soldier cutting her stomach with a butcher knife, when another women tries to save the fetus, she was shot too. Many infants were butchered and killed. They raped school girls and later slaughtered them, molested old women and sexually mutilated others. Cutting off ears to remove earrings. Meir Pa'il described the Irgun and Lehi fighters "with their eyes glazed over, full of lust for murder". Jewish Guerrillas were "eating with gusto amongst the dead"! Some DREAM BIBI!

The elephant left in the other room called CEASEFIRE FIRE STILL CHAINED TO HIS TETHER! The CBC had live coverage in Canada. CNN very little, talking over it at times, Morning Joe Nada! Watching it live I took away the same feeling of Chris. Its quite laughable hearing the Zionist supporters view. John Manley once a temp Prime Minister pointed out that their were 12 bakeries feeding Palestinian's, no mention the IDF blew them up in the first place! He further goes down his delusion hole of duplicity praising the fact they didn't call for a ceasefire. Ignoring the lack of which would make aid impossible! He then praised the IJC for calling for the immediate release of "hostages", again impossible without a ceasefire and negotiations with Hamas! I had the best laugh when the only vote against every point was the lonely Zionist Apartheid Judge from Israel! I guess for the Genocide Joe club, the only proof of Genocide is when the Palestinians are pushed into the Sinai!

Your idea that Hamas "very much wanted Israel's IDF to do in Gaza, what the IDF did..." is pure (and pointless) speculation on your part. If you're a lawyer, you appear to be a very poor one. Further, the "World Court" did not conclude what you speculate. More bullshit from you. Despite what you think, many (including myself) believe this is a winning step for South Africa...and the rule of law on the international stage.

While everyone knows the judicial standing of the ICJ has no executive power to enforce any ruling, the judgements issued today are, nonetheless, legally binding. Since Israel choose to defend the case brought by South Africa, they are in a bind on this ruling despite their attempts to mock it. In my opinion, Israel continues to tarnish its short history on the international stage. Many folks may have forgotten about the attack on the U.S.S. liberty in 1967---but not all; including myself. Reputations and illegal actions matter in terms of international diplomacy. The ICJ, in my opinion, has left it up the U.N> security council to take up the matter of enforcement of today's pronouncements. I also believe the U.N. Secretary General is not finished with the U.S on the matter of a cease fire resolution.

As for your request to comply with any of your preferences in referencing myself on this forum: Piss up a rope.

The World Court made a clear statement how it views the war in Gaza, and that was not what Chris Hedges or Hamas or Israel hoped would happen. Only the blind cannot see that Hamas hoped the Oct 7 attack would provoke Israel to do what it did in Gaza, to turn the world against Israel, but the power brokers in America didn’t ignore Hama’s bait, yet, nor did The World Court fall for it. Radical Islam thinks nothing like people in Western Europe and America. It views itself as Allah’s army against Evil. Radical Islam is willing to die fighting for Allah, and to sacrifice a lot more martyrs than IDF already killed in Gaza, to try to turn even America against Israel.

Even #10 DENIAL "denial is the tenth stage that ALWAYS follows genocide. It is among the surest indicators of further genocidal massacres. They deny that they committed any crimes and often blame the victims. They block investigations of the crimes and continue to govern until driven from power by force. The best response to denial is punishment by an International Tribunal or National Courts. The SAME ICJ court Zionist Israel is Smearing before your eyes!

I agree with you about Israel, but unfortunately, and The World Court saw it, which is why it cut the Gaza baby in half, Hamas tried to provoke Israel to do what it did in Gaza, to turn the entire world against Israel.

Unable to defeat Israel militarily and destroy it, Hamas, as per its Charter’s mission statement, became willing to sacrifice every person in Gaza to turn the world against Israel. Israel took Hamas; October 7 bait, and here we are, with the World Court waffling, and the UN recently earning some of its workers participated in the October 7 raid. Stephen King, stand up and take a bow.

What should the response be of the millions who support the onslaught and the hundreds of thousands that take part in it? What should have been the response for the illegal wall, illegal land theft and settlement building? The PLO, PA and Hamas have toned down their initial calls for complete victory. Israel is the one that never has and has no intention of ever doing. Including any possibility of a 2 State solution! The US Viceroy Baghdad Bob Blinken, just tried to bribe Egypt by cancelling their foreign debt and $ billions more to care for 2.3 million and ethnically cleanse Gaza! Orwell's description of Obrien fits every Zionist leader that ever existed!

I’m not disputing the history of that region, which includes Hamas was unable to destroy Israel, which was the stated goal in iHamas's Charter, and Hamas was not able to defeat Israel’s military, and so the guy running Hamas, Sinwar is his last name, after 20 or so years in an Israel prison, where he studied Israel intensely, came up with a different strategy, which was to provoke Israel to destroy its reputation worldwide, and, except for about half of America, that’s what Israel has done since October 7, which happened to be my birthday.

I am a lawyer. Lawyers and judges are trained to cut ot the chase, substance over form, it is called in jurisprudence. The World Court’s opinion cut to the chase. The justices saw enough to understand Hama’s strategy, and the Court’s opinion reflects that.

I wish President Biden would cut Israel loose and bring his troops home to defend America from the invasion from Mexico and to defend American school children from NRA/US Supreme Court-enabled domestic terrorists, and to stop a civil war, if Donald Trump is jailed or loses the 2024 election.

Unfortunately,, there are a lot of MAGAs and such in the US military, and I imagine they will not fight for the American government against Donald Trump, who told Israel he is their best friend, hoping every Jew and conservative Christian in America would vote for him.

Here is the first part of The Wall Street Journal report on the World Court’s decision. When I practice law, when a court basically leaves each side where the court found them, which seems to be the case with the World Court, we called such a case a “dog fall”.

Wall Street Journal

Updated January 26, 2024, 3:07 pm EST

World Court Rejects Demand for Gaza Cease-Fire

International Court of Justice orders Israel to take measures to prevent destruction of Palestinian community, avoid incitement and facilitate humanitarian aid

Follow the WSJ

The International Court of Justice declined a plea to order Israel to cease military operations in Gaza following Hamas’s Oct. 7 terrorist attacks but required the Jewish state to enable humanitarian aid to the enclave’s civilian population and take every measure to prevent destruction of its Palestinian community.

Friday’s decision, adopted by an overwhelming majority of the United Nations court, was a nuanced response to a blood-soaked conflict that began with Hamas’s massacre of more than 1,200 people in Israel, triggering an Israeli military campaign that Gaza officials say has claimed more than 25,000 lives.

“The court is acutely aware of the extent of the human tragedy that is unfolding in the region and is deeply concerned about the continuing loss of life and human suffering,” the ICJ’s American president, Joan Donoghue, said in announcing the ruling from the Peace Palace in The Hague.

The ICJ order came a month after South Africa initiated proceedings accusing Israel of violating the 1949 Genocide Convention, and two weeks after hearings where South Africa, backed by the Palestinian Authority, presented its case, portraying the Gaza operation as a continuing assault on Palestinians that began with Israel’s establishment in 1948.

Israel, in rebuttal, said that its military complies with international legal obligations and that noncombatant casualties had been exacerbated by Hamas’s practice of locating fighters and supplies in civilian areas.

To side with South Africa, the court had to find that its allegations, if true, could be in violation of the treaty; a final determination of those questions could take years of litigation.

In Friday’s provisional orders, adopted In a series of near-unanimous votes, the world court required Israel to punish incitement to genocide in the Gaza Strip, preserve evidence of potential violations of the treaty and report back to The Hague on its compliance. It also called for the immediate and unconditional release of hostages taken by Hamas during its Oct. 7 attack and held by it and other militant groups.

But the court stopped short of the fundamental objective South Africa and its allies sought: ordering an immediate end to Israel’s military campaign in Gaza.

Both sides claimed vindication.

“Our war is against Hamas terrorists, not against Palestinian civilians,” Israeli Prime Minister Benjamin Netanyahu said shortly after the decision. “We will continue to facilitate humanitarian assistance, and to do our utmost to keep civilians out of harm’s way, even as Hamas uses civilians as human shields.”

South Africa’s Foreign Ministry called the decision “a decisive victory for the international rule of law and a significant milestone in the search for justice for the Palestinian people.” The ICJ, it said, “has determined that Israel’s actions in Gaza are plausibly genocidal and has indicated provisional measures on that basis.”

I mostly agree with you, Jenny. Although a lawyer, I have no international law experience, and while I imagined The World Court was sort of like, say, the U.S. Supreme Court, in the sense that the justices all get to put in their two cents worth, before a decision is handed down (published), I wasn’t sure, so so I went to Wikipeida and found:

*******************

The International Court of Justice (ICJ; French: Cour internationale de justice, CIJ), also called the World Court,[1] is the only international court that adjudicates general disputes between nations, and gives advisory opinions on international legal issues. It is one of the six organs of the United Nations (UN),[2] and is located in The Hague, Netherlands.

The ICJ is the successor of the Permanent Court of International Justice (PCIJ), which was established in 1920 by the League of Nations. After the Second World War, the League and the PCIJ were replaced by the United Nations and ICJ, respectively. The Statute of the ICJ, which sets forth its purpose and structure, draws heavily from that of its predecessor, whose decisions remain valid. All member states of the UN are party to the ICJ Statute and may initiate contentious legal cases; however, advisory proceedings may only be submitted by certain UN organs and agencies.

The ICJ consists of a panel of 15 judges elected by the UN General Assembly and Security Council for nine-year terms. No more than one judge of each nationality may be represented on court at the same time, and judges collectively must reflect the principal civilizations and legal systems of the world. Seated in the Peace Palace in The Hague, Netherlands, the ICJ is the only principal UN organ not located in New York City.[3] Its official working languages are English and French.

Since the entry of its first case on 22 May 1947, the ICJ has entertained 191 cases through 13 November 2023.[4] Pursuant to Article 59 of the Statute of the International Court of Justice, the court’s rulings and opinions are binding on the parties with respect to the particular case ruled on by the court.

Expand full comment

Continuing my other comment to what you wrote, Jenny.

From what I have read, The World Court’s Gaza opinion is the view of the entire court panel, as I am not aware yet of any dissents. What leaped out at me, which I think was really important to the entire panel, is that Hamas needs to release its October 7 hostages, which tells me the panel is not giving Hamas the free pass it has consistently gotten from Caitlin and everyone I have discussed this with at Caitlin’s place.

I think the panel should have gone further, by deciding Israel’s IDF was committing genocide in Gaza. I think the panel should have condemned President Biden and America for not stopping to supply Israel with arms and munitions after Biden saw what IDF was doing in Gaza, which, was what Hamas hoped Israel would in Gaza, which, as a lawyer, I bet The World Court justices also figured out. Meaning, Hamas was okay with IDF killing a whole lot of Gazans and destroying where they lived, in an attempt to destroy Hamas. And, I think the justices are acutely aware that Hamas uses the Gaza civilians as human shields, for the very purpose of getting a whole lot of Gaza civilians killed by IDF.

If Chris Hedges had taken that approach, I would have been with him all the way. But he didn’t, and I think The World Court’s decision reflects the reality that Hamas is a monster, too, but what can The World Court do about Hamas? Nothing, except what it did in its ruling.

I applaud your dragging karma into this matter, for I agree with you that President Biden and America have created awful karma by helping Israel do what it has done, and will do, in Gaza. It’s beyond just that, though. During the fracas, Donald Trump said he is Israel’s best friend, and he may or may not be that, but he said it because he wats the vote of every Jew and conservative Christian in America. I think anyone who thinks Trump will go hard on Israel is dreaming.

A lot of people in America believe God sent Trump to them, and they will be very upset if he is not elected in 2024. They might revolt with violence, if he is not elected in 2024. The January 6, 2020 insurrection was a tea party compared to what Trump has primed his lemmings to do, if he is not elected in 2024. So, please understand that I worry plenty about that happening where my children and their families live, as do I, but I’m an ornery old geezer, and my continued breathing is kinda unimportant compared to my children and their families' safety.

As for Gaza, I look forward to Hama’s reply to The World Court telling it to release its October 7 hostages, for if Hamas does that, that will put Israel in a really ugly bind, if it does not ceasefire and bring IDF back to Israel.

Expand full comment

Hello Sloan.

If Hamas has to release the hostages then the Israelis have to release all the Palestinians in prison without trial.

Expand full comment

Hi, Jenny.

Have?

I don’t see anyone having control over Israel and Hamas, except Israel and Hamas.

What I see very clearly is Hamas got a whole lot more people killed in Gaza than Palestinians held in Israel prisons and jails, while Hamas bartered its hostages for the release of Israel’s prisoners. That don’t look to me like very good arithmetic on Hamas’s part, unless, as I keep saying at Caitlin’s place, Hamas wanted Israel to kill even more civilians in Gaza, to prove to the world what a monster Israel is, while nobody here sees what the other monster, Hamas, is up to.

The World Court saw what Hamas is up to, and it called Hamas’s hand by telling it to release the October hostages.
